Where the two differ, the German text decides:
1 the party causing the damage has a permanent residence in the Federal Republic of Germany both at the time of the insured event and at the time the attempts at enforcement fail, 2 the insured person proves, irrespective of the enforcement title, that their liability claim is justified in principle and in amount, taking into account the facts actually underlying the insured event and the statutory provisions of a private law nature.
