The obligation to pay arises if, with regard to the claim for damages, 1 a final and enforceable judgment for the liability loss has been obtained against the person causing the harm, or an enforcement order has been issued; 2 a settlement enforceable by the courts has been concluded with the person causing the harm; 3 there is a notarised acknowledgement of debt by the person causing the harm with a submission clause, showing that the person causing the harm personally submits to immediate enforcement against all of their assets, and every reasonable attempt at enforcement has failed.
