A-12 Cover for uncollectable claims, Watercraft Liability Insurance, Basis Plus

A-12.1 The default cover serves to help you, as the keeper of a watercraft, if you are harmed by a third party who has no watercraft liability insurance of their own. That is, the default cover puts you in the position you would be in if the person causing the harm had a watercraft liability insurance with Württembergische Versicherung AG on the same terms as your existing one. The cover of the default cover is therefore defined by these conditions for watercraft liability insurance. The exclusions named there also apply to the default cover. In all other respects the conditions named below apply in addition.

A-12.2 Included, under the conditions applying to this watercraft liability insurance and within the sums insured, is the legal liability of another keeper of a watercraft for losses that you yourself suffer as the keeper of a watercraft, if and so far as the justified claim for damages against the person causing the harm cannot be enforced because that person lacks the necessary financial means or has not taken out adequate liability insurance (default cover). The claim for damages must amount to 2,500 euros or more (threshold). The other keeper of a watercraft cannot derive any rights from this contract.

A-12.2.1 Provisional cover for new risks is not part of the cover for uncollectable claims. German law applies to the contract. The German wording of the conditions alone is binding; this translation is provided for understanding only.
