Where the two differ, the German text decides:
permanent impairment is governed by the schedule of limb values (A-2.1.2.2.1), so far as the affected parts of the body, sense organs or internal organs are named there, and otherwise by the extent to which normal physical or mental capacity is permanently impaired (A-2.1.2.2.2). The decisive factor is the state of health caused by the accident that is recognisable at the latest at the end of the third year after the accident. This applies both to the first and to the later assessment of the permanent impairment (A-8.4). German law applies to the contract. The German wording of the conditions alone is binding; this translation is provided for understanding only.
